Terms & Conditions:
1. Definition: "Service" means payment service provided by MMPL for making transactions
like pre-paid recharges, top-ups, bill payments, buy air/rail/movie tickets etc.
"Wallet" means the electronic money created on availing the Service for making payments
as may be permissible as per local laws. "Customer" means any person who uses the
2. Disclaimer of Warranties: Customer expressly agrees the use of the service is
at Customer's own will. The service is provided on an "As is" & "As Available" basis.
3. Privacy: Customer intends to use the Services provided by MMPL at Customer's
own will. At the time of registration you may share certain Personal Information
with MMPL. We respect your Personal Information and we endeavor to protect your
Personal Information as per existing Law. Such Personal Information may include
your personal identifiable information such as name, address, telephone no., mobile
no., E-mail IDs, bank account no., credit/debit cards no. and any other Personal
Information as per existing law which Customer may share. It is understood that
any Customer information provided by Customer to MMPL will be made available to
any statutory and regulatory authority if so required without prior intimation to
Customer. The Customer expressly agrees to give identification details if required
by MMPL to start/block his/her services at the sole option of MMPL.
4. Liability Limitation: MMPL shall not be liable to Customer or any third party
for any direct, indirect, special, incidental, consequential, punitive or exemplary
damages or loss of any kind (Including but not limited to loss of profit, loss of
revenues and the like) howsoever caused, in connection with the service provided
by MMPL, whether arising out of contract or not.
5. Indemnification: Customer agrees to defend, indemnify and hold harmless MMPL,
its employees, directors, officers, agents and their successors and assigns from
and against any and all liabilities, damages, losses, costs and expenses, including
attorney's fees, caused by or arising out of claims based upon the use of Services,
including any claim, violation of any laws and regulations or any other claims that
may occur out of Customer’s usage of the Service.
6. Obligations of MMPL:
a) MMPL shall use best efforts to make the Service available to the Customer at
all times except in cases beyond the reasonable control of MMPL.
b) MMPL shall provide the Services to the Customer subject to availability of balance
in his/her wallet.
c) MMPL has the sole right and discretion to vary or increase the charges at any
time after notifying the Customer by SMS or Email.
d) MMPL will not provide Customer data to any third party as per the governing law
except whenever asked by any authorized agency in writing.
e) MMPL is not liable for any Loss due to limitation of Mobile Network use by Customer.
f) MMPL shall not be responsible for any third party liabilities/injuries caused
by any defect in the Equipment.
g) MMPL shall have the right to transfer or assign or delegate all or any of its
obligation, rights or duties under these terms and conditions to any party. Such
transfer, assignments shall release the MMPL from all its liabilities under these
terms and conditions. MMPL also reserves the right to provide Services through its
agents and Franchises.
h) Any waiver, concession allowed or granted by MMPL to its Customer is limited
to the specific circumstances in which it was given and the same shall not affect
MMPL's right under these terms and conditions.
7. Governing Law: These Terms and conditions shall be governed and construed in
accordance with the laws of India and the parties agree to submit to the sole jurisdiction
of Mumbai courts.
Obligations of Customer:
1. MMPL Service shall not be used for any unauthorized purpose in violation of any
relevant law or against public policy or national integrity and security.
2. The Customer agrees that MMPL shall not be liable for any alleged fault of any
nature in the equipment.
3. The Customer hereby expressly agrees that MMPL has the right to change the terms
of providing the service whether or not such change is necessitated by reason of
Government directions contained in a letter, memorandum, circular agreement, supplementary
license or any order/regulation of Authority.
4. It will be the sole responsibility of the Customer to ensure that the mobile
handset used by him/her is compatible with the services offered by MMPL.
5. The MRP of this form is Rs.30/-.
MMPL is entitled to, without any liability whatsoever to refuse, limit, suspend,
vary or disconnect the Service, in whole or in part, at any time. In its sole discretion,
with respect to one/all Customers without Notice, for any reason which is found
reasonable by MMPL, including but not limited to the following:
a) Government rules, regulations, order, directions, notifications of Authority
etc. including changes there-to prohibiting and /or suspending the rendering of
b) Transmission Limitations caused by topographical, geographical, atmospheric,
hydrological and, or, mechanical conditions.
c) During technical failure, modification, up-gradation, or variation, re- location,
repair and, or, maintenance of the network/equipments.
d) To combat potential fraud, sabotage, willful destruction, etc.
e) If Services are used in any manner which violates any law etc. or adversely affects
or intervenes in any manner, the rendering of Services by MMPL.
f) Any discrepancy/ incorrect particulars provided by the Customers in the Agreement.
g) Breach of any term or condition stated herein by the Customer.
h) Due to problems arising on account of interconnection between MMPL and any Third
Party Service providers.
i) Any other reason, which is found to be reasonable by MMPL warranting suspension/disconnection.
1. Money loaded on the mobile, if not used within 180 days, the mobile wallet will
be expired & forfeited by MMPL. (180 days are from the date of last recharge)
2. As per RBI mandate, money once loaded on the wallet can be used only for buying
products or services & cannot be en-cashed.
MMPL shall not be, directly or indirectly responsible for the break or disruption
of Services on account of force majeure circumstances, such as riots, strike and
lockouts either in the works and office of MMPL or general strike in the city or
in the country, civil disobedience, act of war, flood, tempest, fire, earthquake
or any other act of God or policy of the Government, systems failure, network failure,
any external network or any cause of whatsoever nature beyond the reasonable control,
making it impossible to render the services to the subscriber.
However, the Customer shall continue to pay all Tariffs as per Terms of this agreement
notwithstanding the force majeure conditions. It is understood by the Customer that
provision of Services by MMPL is subject to certain external factors and agencies
who are actively involved in providing the Services to the Customer and MMPL shall
not be liable for the same.
